Cohabitation

During the passage of the Civil Partnership Act 2004, comment was made in both the House of Lords and the House of Commons that the law in relation to heterosexual cohabitees was unsatisfactory.

The Law Commission of England and Wales was asked to consider the issue of cohabitation. The Commission published a consultation paper in June 2006 and, following the consultation, made a series of recommendations regarding the property rights of cohabitees upon dissolution of the relationship.

The Civil Law Reform Division is currently assessing the Commission's recommendations."
