Pleural plaques
In the case of Johnston v NEI International Combustion Ltd and conjoined cases [2007] the House of Lords ruled that pleural plaques did not constitute actionable damage for the purpose of the law of negligence.
On 13 October 2008 DFP issued a consultation paper seeking views on how those with pleural plaques could be supported. A range of options was highlighted, including the possibility of legislative change to overturn the decision in the Johnston case and a no-fault payment scheme.
The consultation period concluded on 12 January 2009 and the submissions received are currently being considered.
